HUNGARY – 2024 Brings Changes to Immigration Rules

Hungary is implementing significant changes to its immigration regulations, aiming to tighten requirements for foreign nationals seeking work permits. Here’s an overview of the key updates:

  1. New Permit Categories:
    • Skilled Workers Permit: Eligible skilled applicants can reside in Hungary for up to three years.
    • Guest Workers Permit: The number of guest workers allowed will be determined by the number of vacant job positions in Hungary. Guest workers will have limited stays and cannot apply for permanent residency or sponsor family members. A resident labor market test by the Hungarian sponsoring company will be required.
  2. Implementation Plan:
    • Suspension Period: Between January 1, 2024, and February 29, 2024, immigration application processing will be suspended. No new employment permit requests can be submitted during this time. Applications submitted before January 1, 2024, will be processed after February 29, 2024.
    • Existing Applications: Work permit applications submitted before January 1, 2024, will be considered under the previous regulations if fully paid and submitted electronically by December 31, 2023.
    • Residence Permit Extension: Residence permits expiring during the suspension period will be automatically extended until April 30, 2024.
    • Resumption of Applications: New applications can be submitted starting from March 1, 2024.
    • Suspension Extension: The suspension also applies to new residence permit applications, residence cards, and EU registration cards. Exceptions may be made for applications deemed to be of national interest.
  3. Impact on Employers:
    • Workforce Planning: Employers should consider the impact of these changes on workforce planning, as no applications will be accepted or permissions issued during the suspension period. Pending applications may also be affected.
